Introduction

These Terms and Conditions (“Terms”) govern your access to and use of the Fantasy Players Points mobile application and website (collectively, the “Service”). Please read these Terms carefully before using our Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

Account Registration

To use certain features of the Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if any information provided during registration or thereafter proves to be inaccurate, not current, or incomplete.

Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of Fantasy Players Points and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Fantasy Players Points.

User Content

You retain all rights to any content you submit, post, or display on or through the Service (“User Content”). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with providing and promoting the Service.

You represent and warrant that:

• You own or have the right to use and authorize us to use your User Content
• Your User Content does not violate the rights of any third party
• Your User Content complies with these Terms and applicable law

Prohibited Uses

You agree not to use the Service:

• In any way that violates any applicable law or regulation
• To exploit, harm, or attempt to exploit or harm minors
• To transmit any material that is defamatory, obscene, or otherwise objectionable
• To impersonate or attempt to impersonate another user or person
• To engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the Service
• To attempt to gain unauthorized access to any portion of the Service
• To interfere with the proper working of the Service
• To use the Service for any fraudulent or illegal purpose

In-App Purchases and Payments

The Service may offer in-app purchases or premium features for a fee. All fees are in U.S. dollars and are non-refundable except as required by law.

By initiating a purchase, you authorize us or our third-party payment processor to charge your chosen payment method. You agree to provide current, complete, and accurate billing information.

We reserve the right to change our prices at any time. If we change pricing for a subscription service, we will provide notice of the change and an opportunity to cancel before the change takes effect.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including, without limitation, if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to delete your account.

Limitation of Liability

In no event shall Fantasy Players Points, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

To the maximum extent permitted by applicable law, our total liability to you for any damages shall not exceed the amount you paid to us in the last six months, or $100 if you have not had any payment obligations to us.

Disclaimer

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. We expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We make no warranty that the Service will meet your requirements, be available on an uninterrupted, secure, or error-free basis, or that defects will be corrected.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Any legal action or proceeding relating to your access to or use of the Service shall be instituted exclusively in the federal or state courts located in San Francisco County, California.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice before the new terms take effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised Terms.
